We at 20/20 are committed to providing dedicated,
reliable and robust Internet services. We do this by providing certain
options, which are not necessarily offered by other service providers.
20/20 provides a complete service; the monthly service charge covers all
bandwidth charges, line fees, and ISP costs.
Privacy:
20/20 recognizes and respects the privacy of our users.
Your personal information will not be sold or distributed to any outside
company or agency. We will only disclose your personal information in the
event of a court-order.
Email:
At 20/20, email is the primary way that
we communicate with our customers.
Users must provid a vaild University of Michigan email
address when signing up.
Your University of Michigan email account will be used
to communicate vital information about your services, billing, service
outages. Often this information is time-sensitive in nature, so it is
imperative that you read any email sent to your account to avoid any
potential interruptions in your service.
Bandwidth and
Connect Time:
As an ISP, our bottom line is determined
partially by the amount of bandwidth and Connect Time our customers
utilize. We believe that we can normally balance that cost and
utilization while continuing to provide great service to all of our
customers. We have an official policy of Unlimited Bandwidth and Connect
Time. Our customers will not be charged for the bandwidth or connect time
consumed, nor do we have specific limits or caps on that
bandwidth/connect time. However, if you provide or subscribe to a service
that utilizes sufficient bandwidth/connect time that it affects our core
equipment, overall network performance, or other users' services, we may
require that you cease or alter these activities. Failure to comply may
result in bandwidth/connect time limitations or service cancellation.
Billing:
In order to provide you with the best possible service
at the lowest possible cost, billing is via credit card. On the
twentieth of the month before the next billing cycle, 20/20 attempts to
charge your credit card or bank account for your term subscription fee.
If the charge is not successful, you will receive a notice via email and
20/20 will continue to attempt to charge your account until the first of
the month. You may update your credit card or bank account
information at http://member.2020comm.net. If 20/20 is unable to
charge your account by the first of the month, your account will be
suspended until other payment arrangements are made.
For the first fractional month of service you will be billed an averaged,
prorated charge of $1.00 regardless of the date of
subscription.
Cancellation:
You may cancel your service at any time, and you account will
remain active through the end of the current pre-paid period. There
is no cancellation fee.

Indemnification:
You will indemnify and
defend 20/20 and all employees, officers, directors and agents of
20/20 from and against any and all claims, damages, losses,
liabilities, suits, actions, demands, proceedings (whether legal or
administrative) and expenses (including but not limited to reasonable
attorneys’ fees incurred with or without suit, in arbitration or
mediation, on appeal or in a bankruptcy or similar proceeding)
(collectively, “Claims”) threatened, asserted, or filed by a third party
against any of the Indemnified Parties to the extent that such third
party Claims arise out of or relate to (i) the breach or alleged
breach of this Agreement by You; (ii) any negligent or tortuous act
or omission to act by You; or (iii) any claim that the data content
delivered by You via the Services provided by 20/20 under this
Agreement constitutes an infringement of any confidential information,
trade secret, patent, copyright, trademark, trade name, or other legal
right of any third party.
Limitation
of Liability:
In no event shall 20/20 be liable for
any indirect, incidental, special or consequential damages, or loss of
profits, revenue, data or use, by You or any third party, whether in an
action in contract or tort or strict liability or other legal theory,
even if 20/20 has been advised of the possibility of such damages. If You are dissatisfied with the
service or with any terms, conditions, rules, policies, guidelines or
practices of 20/20 in operating the Service(s), Your sole and exclusive
remedy is to discontinue using the Service(s). 20/20’s entire liability for any claim,
loss, damage or expense from any cause whatsoever shall in no event
exceed sums actually paid to 20/20 by You for the specific Service giving
rise to the claim. 20/20 shall not
be liable for failure or delay in performing its obligations hereunder if
such failure or delay is due to circumstances beyond its reasonable
control, including, without limitation, acts of any governmental body,
war, insurrection, sabotage, embargo, fire, flood, strike or other labor
disturbance, interruption of or delay in transportation, or inability to
obtain raw materials, supplies, or power used in or equipment needed for
provision of the services described in the Service Contracts.
